Gestión del sistema de control de tráfico marítimo en Colombia
El libro está compuesto por diez capítulos: En el primer capítulo se hace una
descripción del control de tráfico marítimo en el entorno mundial y en Colombia.
En el capítulo dos se estudia el movimiento de carga en el país junto a la caracterización
de cada Capitanía de Puerto en general. El estudio de la infraestructura y equipos se realiza en el capítulo tres. Los temas de formación de personal y
marco legal de la actividad de tráfico se estudian en los capítulos cuatro y cinco,
respectivamente. La reflexión sobre la administración de los centros VTS de Alemania,
se aborda en el capítulo siguiente. En el capítulo séptimo se hace un estudio
comparativo entre el sistema de control aéreo y marítimo, también se hace
un análisis DOFA sobre la DIMAR, como el ente que regula el control de tráfico
marítimo en el país. En los capítulos restantes se estudian los costos de los centros
VTS, se presenta una visión referida a un nuevo modelo de implementación
de un sistema de control de tráfico marítimo en Colombia; a su vez, se analizan
las tendencias en materia de desarrollo de VTS que, según la IALA (International
Association of Lighthouse Authorities), serán las predominantes para los tiempos
venideros. Por último, se hacen unas reflexiones y recomendaciones para que
el sector marítimo del país pueda ser más dinámico a futuro y se redactan las
conclusiones alusivas al trabajo.The book is composed of ten chapters: In the first chapter there is a

Chapter two studies the movement of cargo in the country together with the characterization
of each Harbor Master's Office in general. The study of infrastructure and equipment is done in chapter three. The topics of personnel training and
legal framework of traffic activity are discussed in chapters four and five,
respectively. The reflection on the administration of the VTS centers of Germany,
it is addressed in the next chapter. In the seventh chapter a study is made
comparative between the air and maritime control system, it is also
a SWOT analysis on the DIMAR, as the entity that regulates traffic control
maritime in the country. The costs of the centers are studied in the remaining chapters
VTS, a vision referred to a new implementation model is presented
of a maritime traffic control system in Colombia; in turn, they are analyzed
trends in VTS development that, according to the IALA (International
Association of Lighthouse Authorities), will be predominant for the times
coming. Finally, some reflections and recommendations are made so that
the maritime sector of the country can be more dynamic in the future and the
conclusions allusive to work

Ship Registers: Study of the different systems and revision of the Special Shipping Register of the Canary Islands
Los buques se someten al ordenamiento jurídico del Estado cuyo pabellón enarbolan. A su vez, los Estados mantienen el control a través de un sistema de registros. El objetivo del trabajo es analizar la influencia que ejercen en la elección del pabellón las características propias de cada tipo de registro marítimo, teniendo en cuenta las exigencias del tráfico internacional. En la actualidad, gran parte de la flota mundial está inscrita en “registros abiertos”, instaurados en países que ofrecen un servicio comercial a los armadores mediante regulaciones más flexibles, lo que permite reducir los costes operativos. Panamá, las Islas Marshall y Liberia lideran el sector, mientras los países marítimos tradicionales han tenido que evolucionar ante la falta de competitividad de sus registros ordinarios. Para ello, establecieron los denominados “segundos registros”, que incorporan medidas más atractivas para la explotación naviera, en un intento de preservar la flota mercante nacional. En España se creó con este objetivo el Registro Especial de Canarias. Sus características, ventajas, y desventajas se han analizado en este trabajo, desde la perspectiva de la situación actual de la Marina Mercante española, y se han recogido una serie de consideraciones acerca de las propuestas que se podrían introducir para que siga siendo viable a medio y largo plazo.Vessels are subject to their Flag State legal system. Likewise, States exert control over them through a registry scheme. This study aims to analyze the influence that the specific characteristics of every type of ship register can exercise on the election of the flag, taking into account the demands of international traffic.
Currently, a great part of the world fleet is registered in “open registries”, settled in some countries which offer a commercial service to shipowners through flexible regulations. This allow them to reduce operational costs. Panama, the Marshall Islands and Liberia lead the industry, while traditional maritime States had to evolve due to its ordinary registries ́ lack of competitiveness. Thereby, they established the so-called “second registers”, with more appealing measures for shipping, so as to keep the merchant fleet under the national flag. For that purpose, it was created the Special Shipping Register of the Canary Islands in Spain. This study will assess its main aspects, advantages and disadvantages, regarding the present situation of the Spanish Merchant Marine. Different observations are made about several proposals that could be introduced so that it can be viable in the middle and long term.151 página
Incidencia del decreto ley 2324 de 1984 en el derecho marítimo colombiano
DerechoEn este trabajo se estudia el estado actual del derecho marítimo colombiano tomando como epicentro el Decreto Ley 2324 de 1984, el de mayor actualización y proyección en Colombia, sin desestimar la importancia del Estatuto de Puertos de 1991. Se tiene en consideración la perspectiva sistémica que hoy se prodiga en torno al mar en el país, la cual pretende incorporar bajo la única égida de la Dirección General Marítima -DIMAR-, investigaciones oceanográficas, explotación de recursos naturales de suelos y subsuelos, manejo y preparación de fenómenos metereológicos marinos, contaminación, gestión de aguas, y lo que en especial atañe al trabajo presente, accidentes o siniestros marítimos. Igualmente la referencia de los convenios internacionales suscritos por el país. De hecho la actividad y la legislación marítima están estrechamente relacionadas con otros elementos del sistema nacional e internacional, convergiendo a nivel jurídico áreas administrativas, comerciales, penales, constitucionales, constituyéndose así en un gran reto para nuestros juristas y centros de educación superior. Se demandan estudios consistentes y continuados que aborden y escruten alcances y limitaciones de la legislación nacional en su pretensión de respaldar el sistema, especialmente en el marco del Tratado de Libre Comercio, en donde el mar y los puertos juegan un papel preponderante. La jurisprudencia generada por nuestras Altas Cortes corresponde a un material de primer orden. Si bien han ponderado el significado de la codificación de 1984, también denuncian sus debilidades. En los litigios el Estado resulta casi siempre perdedor por desconocimiento del derecho, por errores de procedimiento y otras debilidades. En este trabajo se contemplan tales eventualidades bajo la óptica del mencionado sistema, y sobre todo particularizando en casos atendidos por dichas corporaciones. Asimismo se cursan recomendaciones concretas, destacando en especial la necesidad de que los jueces marítimos adquieran la importancia que en cambio sí tienen en países de avanzada.In this paper, the current state of Colombian maritime law is studied, taking as its epicenter Decree Law 2324 of 1984, the most updated and projected in Colombia, without underestimating the importance of the 1991 Ports Statute. The systemic perspective Today it is lavish around the sea in the country, which aims to incorporate under the sole aegis of the General Maritime Directorate -DIMAR-, oceanographic investigations, exploitation of natural resources of soils and subsoils, management and preparation of marine meteorological phenomena, pollution, water management, and what especially concerns present work, accidents or maritime claims. Likewise, the reference of the international agreements signed by the country. In fact, maritime activity and legislation are closely related to other elements of the national and international system, converging at the legal level administrative, commercial, criminal, constitutional areas, thus becoming a great challenge for our jurists and higher education centers. Consistent and continuous studies are demanded that address and scrutinize the scope and limitations of national legislation in its attempt to support the system, especially within the framework of the Free Trade Agreement, where the sea and ports play a preponderant role. The jurisprudence generated by our High Courts corresponds to a material of the first order. While they have pondered the meaning of the 1984 codification, they also denounce its weaknesses. In litigation, the State is almost always the loser due to ignorance of the law, procedural errors and other weaknesses. In this work, such eventualities are contemplated from the perspective of the aforementioned system, and above all by specifying in cases attended by said corporations. Likewise, specific recommendations are made, especially highlighting the need for maritime judges to acquire the importance that they do have in advanced countries
